Welcome to The Deep Rig Movie! Along with other community-based organizations, and in the interest of transparency, we have established Terms and Conditions for our visitors and contributors to read. We encourage you to read these Terms and Conditions before using any of The America Project's Platforms, and before submitting any content in any form or medium for publication. The America Project, Inc reserves the right to change these Terms and Conditions at any time without notice, and you agree to be bound by such changes via your continued use of the site or submission of content. Unless otherwise expressed, these Terms and Conditions apply to all new features or functionalities on our websites and systems that support and enhance your experience of our platforms. Definitions for this paragraph and the rest of the Terms and Conditions are below.
The Deep Rig Movie: The Deep Rig Movie and The America Project refer to The America Project, Inc and all affiliates
Platform(s): Platform or Platforms includes but is not limited to websites, blogs, and social media pages.
Content: Content includes but is not limited to information, data, text, photographs, audio clips, videos, written posts, articles, comments, scripts, graphics, and interactive features generated by, provided to, or otherwise made accessible on or through a Platform.
Submitted Content: Any Content provided to The America Project, in any form or through any method, by individuals or entities not employed by The America Project, for possible use or dissemination on The America Project's Platforms.
Submitted Event(s): Any Content about a planned event or activity being organized, planned, or held by an entity or individual other than The America Project, provided to The America Project, in any form or through any method for possible use or dissemination by The America Project on our Platforms.
The America Project's Content
All Content on The Deep Rig Movie is protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries, and The America Project has all rights therein, subject to the limitation of the rights of our licensees and licensors under applicable agreements or arrangements. All opinions and positions expressed in The Deep Rig Movie's content are the opinions and positions of the individual content generator; publication or dissemination does not constitute The America Project's endorsement of such opinions and positions, unless explicitly stated to the contrary.
Community-generated Content is welcomed and encouraged. When you provide Submitted Content to our sites, you grant us an unqualified, unconditional, unlimited, worldwide, non-exclusive, perpetual, royalty-free, fully paid, fully sub-licensable, assignable and transferable license and right to edit, use, host, cache, store, maintain, reproduce, display, exhibit, broadcast, transmit, modify, truncate, aggregate, distribute, reproduce, prepare derivative works of, perform, display, and otherwise fully exploit such Submitted Content in connection with The Deep Rig Movie for any purpose, including but not limited to promotional and marketing, in any form or format, and on or through any media or medium and with, any technology or devices now known or hereafter developed or discovered.
Whether or not a separate agreement between you and The America Project establishes a monetary fee for Submitted Content, you agree that for your Submitted Content to be considered for use is adequate consideration for the rights granted herein. Providing Submitted Content to The America Project does not guarantee that such content will be published or used by The America Project in any fashion. The America Project has the right to reject use of Submitted Content for any reason whatsoever.
By submitting Submitted Content to The America Project, you affirm that you are solely responsible for the submission and the consequences of publishing or disseminating it. You also agree to indemnify The America Project for any claims arising out of the publication or dissemination of your Submitted Content, including but not limited to claims arising from breach any of the following representations and warranties. In connection with each piece of Submitted Content, you affirm, represent, and warrant the following: 1) that you own or have the necessary rights, consents, and permissions to use and authorize The America Project to use all patent, trademark, trade secret, copyright or other property rights connected to the Submitted Content sufficient to enable use of such submissions in the manner contemplated by us and these Terms and Conditions; 2) that the Submitted Content is not bound by a third party's intellectual copyright, trademark, patent, or exclusive license; 3) that you have reasonably verified assertions of fact and details in the Submitted Content and that the Submitted Content is free of libelous statements about any individual or entity; and 4) that you have not manipulated visual or audio content in order to intentionally create confusion or misrepresent truths about the subject-matter contained therein.
The America Project websites list and share information about community events. The America Project retains the right to list or not list Submitted Events at our sole discretion. In general, a Submitted Event should appeal to a wide audience, meaning that it is open to individuals beyond an organization's membership, and is likely to attract a reasonably large group of participants. The America Project has the right to edit Submitted Event information for style, accuracy, grammar, and content. The listing of a Submitted Event by The America Project on any Platform does not constitute the endorsement of The America Project or The America Project's agents of the Submitted Event's purpose, cause, positions, or organizers, unless explicitly stated to the contrary. The America Project makes every effort to avoid errors in event listings and to keep event listings updated, but The America Project is not responsible for any errors or outdated information. Organizers should check Submitted Event listings for accuracy and are required to inform The America Project of any changes to the details of the Submitted Event listed on any of The America Project's Platforms. The America Project is not liable for any loss or damage incurred by any party as a result of any error on The America Project's Platforms, any delay in listing a Submitted Event, any decision not to list a Submitted Event, or any decision to list a competing or contemporaneous event on The America Project's Platforms.
Third Party Websites
The America Project's Content and Platforms may link to third party websites for a variety of reasons, such as linking to an information source, content provider, or advertiser. The America Project and its affiliates are not responsible for any of the content on third party websites, nor does a link to the website constitute an endorsement of its purpose or content by The America Project, Inc or its affiliates. If you notice that The America Project, Inc or one of its affiliates is linking to a questionable website, please inform The America Project's Support Team.
The communications between you and The America Project, Inc. are electronic. You hereby consent to receive any and all communications from The America Project, Inc. in electronic form, via electronic mail ("e-mail"), text message ("SMS") or website page. You agree that all agreements, notices, disclosures, terms, conditions and other legal communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if they were in writing.
Your permission to use the Sites and Services is conditioned upon your agreement that you:
- are of legal age in your current location to form a binding contract with The America Project, Inc.,
- will comply with these Terms while using the Sites and Services,
- are not prohibited, by law or prior notice from The America Project, Inc., from accessing our Sites and Services,
- are not acting on behalf of anyone prohibited in the prior clause,
- will only have, at most, one User Account with The America Project, Inc.,
- shall take reasonable measures to ensure your User Account's safety, and
- agree to be responsible for your use of the Sites and Services.
In addition, the following are prohibited without express, prior and written permission from The America Project, Inc.:
- submitting false or purposely inaccurate information,
- any commercial use of the Sites and Services, its Content or any User Content,
- data mining, harvesting, screen scraping and the collection of Content from the Sites and Services, excluding that permitted by industry standard-compliant search engine access,
- deep linking, framing or redisplay of any Content,
- inteferring with the proper functioning and availability of the Sites and Services.
Any prohibited use shall immediately terminate any permission(s) to access the Sites and Services, and in such event, The America Project, Inc. may prohibit access to the Sites and Services at its leisure from your internet address ("IP Address") or network.
Delivery and Payment
If you have ordered and paid for a physical product from The America Project, Inc., we will indicate the timeframe in which we expect the product to arrive. If you have not received any further communication from us with updates, and your product is one week after the expected delivery date, please contact us at [email protected] or call (833) 420-1776 for assistance.
All payments are due immediately, and products or services will be not rendered or delivered until payment is received.
Refund and Returns
For a refund, simply contact [email protected] for assistance, or call (833) 420-1776 to arrange to return the product and receive a full refund, minus any shipping costs.
You acknowledge that there may be interruptions or periods of unavailability of the Sites and Services for any reason, including unscheduled maintenance. You acknowledge that due to circumstances beyond our control access to the Sites and Systems may be interrupted, restricted, suspended or terminated. The America Project, Inc. retains the right to deny access to the Sites and Systems at any time and for any reason.
Modification of this Agreement
We reserve the right to discontinue or modify any part of these Terms at any time as we deem necessary or desirable. If we make changes that materially affect your use of the Sites and Services we will notify you by sending you an e-mail to the e-mail address that is registered with your account and by posting notice of the change on the root page of Sites affected. Use of the Sites and Services after we update the Terms will constitute acceptance of the modified Terms immediately.
Copyright and Trademark
All contents of the Sites and Services are, unless otherwise stated, copyrighted under United States copyright laws and similar laws of other jurisdictions by The America Project, Inc. or our affiliates or partners. You may not, without prior written notice, copy, modify, reproduce, download or distribute any copyrighted content from the Sites and Services except as is provided expressly in the Terms.
The America Project logo and other America Project graphics, logos, page headers, buttons and styles are trademarks, registered trademarks or trade dress of The America Project, Inc. in the United States and/or other jurisdictions. All other trademarks not owned by The America Project, Inc. that appear on this site are the property of their respective owners.
While The America Project, Inc. will make every attempt to transmit text messages, emails and phone calls in a timely fashion, at no time shall The America Project, Inc., or any subsidiary, business partner, affiliates or successors be held responsible for failure to transmit these items within the given schedule.
Disclaimer of Warranty
YOU EXPRESSLY AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. NEITHER The America Project, Inc., ITS SUBSIDIARIES, AFFILIATES, SUCCESSORS, PARTNERS NOR ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, SHAREHOLDERS, AGENTS, MERCHANTS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO (I) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THIS SITE, OR (II) THE ACCURACY, COMPLETENESS, RELIABILITY OR CONTENT OF ANY INFORMATION (INCLUDING, BUT NOT LIMITED TO, PRODUCT DESCRIPTIONS), SERVICE, PRODUCTS OR OFFERS PROVIDED THROUGH THIS SITE. Limitation of Liability
Governing Law and Jurisdiction; Waivers of Trial by Jury
By using, accessing or visiting the Sites and Services, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Florida, will govern these terms and any dispute that might arise between you and The America Project, Inc. and its subsidiaries and successors. Further, you agree that the validity, interpretation, construction, and performance of the Sites and Services is governed by and is to be construed under the laws of the State of Florida applicable to such services established or performed in the State of Florida, without regard to conflict of laws rules. Further, you agree to the exclusive jurisdiction of the State of Florida and federal courts located in the State of Florida. You further agree to waive any right to trial by jury in connection with any dispute between you and The America Project.
You agree to defend, indemnify and hold harmless The America Project, Inc., its successors, subsidiaries, affiliates and partners and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys’ fees, arising out of or related to any products or services purchased by you in connection with the Sites and Services or any use of the Sites and Services in violation of these Terms.
You are solely responsible for your interactions with Merchants and other users of the Sites and Services. To the extent permitted under applicable laws, you hereby release The America Project, Inc. and its successors, subsidiaries, affiliates and partners from any and all claims or liability related to any product or service of a Merchant, any action or inaction by Merchant, including Merchant’s failure to comply with applicable law, and any conduct or speech, whether online or offline, of any other user.
